Property Tour Terms of Service

These Property Tour Terms of Service (these “Terms”) apply to all customers and potential customers of Truman Homes 1995 Inc. and its affiliated entities (“Truman Homes”) who book a property tour of a Truman Homes property (the “Property” and the “Tour”).
Agreement to Terms
By clicking “I have read and agree to the terms above”, you expressly acknowledge and agree that:

1. You have read, understood, and accepted these Terms;
2. Your acceptance of these Terms is a condition of, and provided as consideration in return for, receiving the Tour of the Property;
3. You have had a reasonable opportunity to review these Terms before accepting them;
4. These Terms apply to you and to anyone who attends the Tour with you on your behalf, and you are responsible for ensuring that such individuals comply with these Terms; and
5. These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, and you submit to the exclusive jurisdiction of the Courts of the Province of Alberta for any dispute arising from or relating to these Terms or Tour.

You acknowledge and agree that Truman Homes has a legitimate interest in protecting the privacy and safety of persons attending the Tour, and the orderly resolution of concerns arising from the Tour. Accordingly, you expressly covenant, acknowledge and agree that you shall not, at any time before, during, or after your Tour (a) engage in the making, publishing, repeating or disseminating of any statement about Truman Homes, Truman Homes’ staff, the Tour, or the Property that you know to be false or misleading; (b) publish images, recordings, the names of staff of Truman Homes, or personal information of other persons obtained during the Tour without consent; or (c) engage in threatening, harassing, defamatory, or unlawful communications relating to Truman Homes, Truman Homes’ staff, the Property, or the Tour. You agree to first notify Truman Homes of any issue, complaint or grievance arising from the Tour and to give Truman Homes a reasonable opportunity to respond and that any issues, complaints or grievances shall be strictly dealt with between the parties. Should you engage in communications or acts contrary to these Terms, Truman Homes is granted the absolute right, in its sole and absolute discretion, without the requirement of providing notice to you, to seek immediate injunctive relief requiring you to immediately cease and desist engaging in the aforenoted conduct. You acknowledge and agree that your acceptance of this provision is considered a material term of these Terms and is provided in consideration for the Tour.
